3. No Professional or Aviation Advice

Flight availability, pricing, itineraries, and aircraft details are estimates only and subject to confirmation by the actual aircraft operator.

Users should consult qualified professionals and carefully review all flight-specific documents before making any travel or business decisions. Aviation ACES is not liable for any decisions made based on information provided on the Site.

4. Charter Services and Third-Party Operators

Aviation ACES typically acts as a charter broker or coordinator, arranging private jet flights and related services with third-party FAA-certified air carriers (Part 135 or Part 121 operators). We do not own or operate aircraft unless expressly stated.

All flights are subject to the terms and conditions of the operating carrier. Aviation ACES makes no warranties regarding the performance, safety, reliability, or suitability of any third-party operator or aircraft. Final confirmation, contracts, payment terms, and operational responsibility rest with the chosen carrier.

Pricing, availability, and aircraft type are subject to change until a formal charter agreement is executed.

5. SMS/Text Messaging

We may offer SMS/text messaging services to provide booking updates, flight alerts, and promotional offers.

By providing your mobile phone number and consenting to receive SMS messages (via a clear affirmative action such as checking a dedicated box), you agree to receive recurring automated text messages from Aviation ACES. These may include:

Transactional/operational messages (e.g., booking confirmations, itinerary changes, flight alerts)
Marketing and promotional messages (e.g., exclusive charter deals and special offers)

Consent Disclosures:

Message and data rates may apply.
Message frequency may vary (typically up to 4–8 messages per month).
Consent is not a condition of purchasing any goods or services.
You may reply STOP to any message to unsubscribe from marketing texts or contact us directly to revoke consent.

TO THE FULLEST EXTENT PERMITTED BY LAW, AVIATION ACES, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SITE OR SERVICES, INCLUDING ANY RELIANCE ON INFORMATION PROVIDED OR ANY ACT OR OMISSION BY A THIRD-PARTY AIRCRAFT OPERATOR.

Our total liability to you for any claim shall not exceed the amount you paid to us (if any) in the twelve (12) months preceding the claim. All use of the Site and Services is at your own risk.

9. Indemnification

You agree to indemnify, defend, and hold harmless Aviation ACES, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in connection with your use of the Site or Services, violation of these Terms, or infringement of any rights of another.
